Here are statements from leaders across New Jersey regarding Superior Court Judge George Leone’s outrageous and unprecedented decision to throw out the votes of 21,000 4th District residents based on flawed legal analysis:
"The federal court has been consistent and clear on the rights of Assemblywoman Elect Mosquera's to have the voters decide on her fitness to serve in office. I am deeply concerned by this unprecedented decision by the court to overrule the will of over 21,000 registered voters in New Jersey's fourth legislative district who join with me in believing that Ms. Mosquera is the most qualified candidate. Further, in a state as diverse as NJ, we should be doing everything possible to encourage women and minorities to run for higher office. Therefore, I am equally troubled by the impact that this decision will have upon the ethnic and gender diversity of the NJ Legislature. I am hopeful that this injustice will be remedied and I look forward to working with Assemblywoman Mosquera in the near future to improve the quality of life of residents in both the fourth district and throughout the state of New Jersey."
- Hon. Robert Menendez, U.S. Senator (D-NJ)
"Federal court decisions clearly establish that Gabby had a right to have her candidacy considered by the voters. Over 21,000 of those voters chose Gabby as their Assemblywoman and their decision should be upheld. I look forward to serving with Gabby as we support our constituents."
-Hon. Robert E. Andrews, U.S. Representative (D-1)
"I wholeheartedly disagree with the unprecedented decision to invalidate the election of 4th District Assemblywoman-Elect Gabriela Mosquera due to a challenge to her residency," said Wisniewski. "This decision has disenfranchised over 21,000 voters in the 4th district. It is a setback to the diversity of the New Jersey Legislature and a blow to our efforts to elect more women to serve. She followed all the rules of the state, but when Republicans couldn't defeat her at the ballot box, they went to the court to have the rules changed after the game had already ended."
- Hon. John Wisniewski, State Assemblyman (D-19), Chairman of the NJ Democratic State Committee
“By ignoring legal precedent, the opinion of the state’s chief election officer, and the overwhelming will of voters, one judge is denying nearly a quarter of a million New Jersey residents the right to full representation in the legislature. It is unfortunate that this one judge has decided that the opinion of the U.S. District Court of New Jersey, which has been used as legal guidance for the last 10 years, is inferior to his own. With less than a handful of Latinas in the legislature, and only 23 out of the 80 incoming Assembly members being women, the decision of one judge to disqualify Gabriella Mosquera from office disproportionately affects two very distinct constituencies, which the new legislative map was designed to help enfranchise. Gabriella Mosquera has spent many years working in government and proven herself to be a bright, energetic and inspirational woman, highly qualified to represent the 4th legislative district, as indicated by the landslide victory she recorded in November. This legally flawed decision must not be allowed to thwart the votes of 21,000 residents. And we trust that this decision will be swiftly reversed by the appellate division.”
-Hon. Nellie Pou, State Senator (D-35), Chairwoman, Appropriations Committee & NJ Legislative Latino Caucus
"The recent court ruling disregarding the will of the voters and their choice of Gabriella Mosquera to serve them in the 4th Legislative District is deeply disturbing. "Firstly, the ruling goes against commonly accepted law based on a federal judge's decision 10 years ago. It's concerning whenever a judge takes it upon himself to disregard established law and overturn the will of more than 21,000 voters in Camden and Gloucester counties. That's not how democracy works. "But this anti-democratic decision also deprives New Jersey of the increased gender and ethnic diversity our Legislature needs if it's to truly represent New Jersey. "I urge the courts to overturn this decision as quickly as possible. The voters of the 4th District - and New Jersey - deserve to have their voices heard and choices respected."
-Hon. Vincent Prieto, State Assemblyman (D-32), Chairman, Assembly Budget Committee
"The Women's Political Caucus of New Jersey (WPCNJ) endorsed Gabby Mosquera because she has the passion and vision necessary to advance issues important to women and their families. We consider it an extreme injustice that an individual judge would overrule the will of more than 21,000 voters of the 4th legislative district that cast ballots to send Gabby to Trenton. We urge the Appellate Division to respect the judgment of the voters in Camden and Gloucester counties by overturning this decision in time for Tuesday's swearing in of the full legislature."
-Lisa Mizrahi Kaado, President, Women's Political Caucus of New Jersey
